O direito à convivência familiar no cumprimento da medida socioeducativa de internação junto ao centro de atendimento socioeducativo do município de Mossoró/RN

Abstract

The purpose of this study was to analyze whether the preservation of the family bond during the application of the socio-educational measure of deprivation of liberty is ensured in CASE / MOSSORÓ, as well as its influence on the socio-educational process of adolescents. It wasdeveloped in three stages, using the bibliographical research in the first two and the last one, the field research. In the initial part, we sought to analyze the relationship between the role of the State / family and the socio-educational process of the adolescents in compliance with the hospitalization measure. In a second moment, a brief overview was made regarding the ECA and SINASE predictions referring to the fundamental right of the familiar coexistence and identified as it occurs the dialogue with the socioeducative reality. In the third part, the objective of this study was to investigate whether the preservation of the family bond during deprivation of liberty has been respected by CASE / RN. Through semi-structured interviews with employees and students, it was possible to understand how the socioeducation of the adolescents in detention in the municipality of Mossoró develops and their perspectives after the fulfillment of the measure in the Educational Center. Finally, it was concluded that it is still far from the guidelines of SINASE, since the Statute provides legal protection for the propagation of policies in order to guarantee respect for the rights of children and adolescents, however it is imperative that the State provides for the effectiveness of the principles related to childhood and youth.
