Abstract
The article deals with the motivations of the courts to litigate. The work was developed not only under the theoretical, but also empirical/understanding approach. Initially, general considerations are made about the total judicialization of life, the professional legal field and the motivations for judicial litigation. Then, field research is carried out through semi-structured interviews with the courts. Thus, the empirical research was carried out in the forum Desembargador Silveira Martins, in the city of Mossoró/RN, in similar institutional environments, as well as in the residence of the court or, still virtually. It is concluded that the total judicialization of life, even being identified as a complex phenomenon, in the case of its strict aspect, would have motivations of sentimental order as predominant in comparison to those of rational order.
