Federalismo fiscal e a reforma tributária: análise da emenda constitucional 132 de 2023

| dc.description.abstract | A dissertação aborda o tema do federalismo fiscal e a reforma tributária, com foco na análise da Emenda Constitucional nº 132, promulgada em 20 de dezembro de 2023. O contexto da pesquisa é a situação problemática do federalismo fiscal brasileiro, caracterizada por altas cargas tributárias, desatualização e concentração de receitas na União, conforme narrado por inúmeros autores tributaristas. Diante disso, várias propostas de reforma tributária estavam em debate até a promulgação da referida Emenda Constitucional, proveniente da PEC nº 45/2019, que foi aprovada com emendas pela Câmara dos Deputados e posteriormente também foi aprovada com emendas pelo Senado Federal. O problema da pesquisa é avaliar se a Emenda Constitucional nº 132 de 2023, ao instituir um Imposto sobre Bens e Serviços (IBS) de competência dos estados, Distrito Federal e municípios e uma Contribuição sobre Bens e Serviços (CBS) de competência da União, viola a forma federativa do Estado brasileiro, a qual é considerada cláusula pétrea no ordenamento jurídico (art. 60, § 4°, I CF), limitando as possibilidades de reforma constitucional. As hipóteses levantadas são que a Emenda Constitucional nº 132 de 2023 não viola a forma federativa do Estado e que podem existir emendas constitucionais que modifiquem o modelo tradicional de competência tributária privativa para cada ente federativo, permitindo a criação de impostos comuns a múltiplos entes. A metodologia adotada para esta pesquisa é baseada em uma abordagem de pesquisa bibliográfica detalhada e analítica e a pesquisa quantitativa, através da análise da arrecadação tributária da União, estados, Distrito Federal e dos dez municípios mais populosos do Brasil, bem como dos recursos transferidos para cada estado e Distrito Federal. Com essa análise de dados fiscais se pretende aferir se a centralização de recursos tributários está na União, qual o tributo do ente central que arrecada mais receita e se os entes subnacionais possuem recursos financeiros provenientes de sua arrecadação tributária própria para custear suas despesas, ou se dependem da União através do mecanismo de repartição de receitas ou até das transferências voluntárias. A pesquisa se apoia na análise crítica e na síntese de fontes acadêmicas, literatura especializada, leis e documentos normativos relevantes sobre federalismo fiscal, reforma tributária e, especificamente, a Emenda Constitucional nº 132 de 2023. | |
| dc.description.abstract2 | The dissertation addresses the topic of fiscal federalism and tax reform, focusing on the analysis of Constitutional Amendment 132, enacted on December 20, 2023. The context of the research is the problematic situation of Brazilian fiscal federalism, characterized by issues such as high tax burdens, outdated legislation, and concentration of revenues in the Union, a situation described by numerous tax authors. Therefore, several tax reform proposals were under debate until the enactment of the aforementioned Constitutional Amendment, originating from Constitutional Amendment Proposal (PEC) 45/2019, which was approved with amendments by the Chamber of Deputies and subsequently also approved with amendments by the Federal Senate. The research question is to assess whether Constitutional Amendment 132 of 2023, by establishing a Tax on Goods and Services (IBS) under the jurisdiction of the states, the Federal District, and municipalities, and a Contribution on Goods and Services (CBS) under the jurisdiction of the Union, violates the federative form of the Brazilian State, which is considered a fundamental clause in the legal system (art. 60, § 4, I CF), limiting the possibilities for constitutional reform. The hypotheses raised are that Constitutional Amendment 132 of 2023 does not violate the federative form of the State and that constitutional amendments may exist that modify the traditional model of exclusive tax jurisdiction for each federative entity, allowing the creation of taxes common to multiple entities. The methodology adopted for this research is based on a detailed and analytical bibliographical research approach and quantitative research, through the analysis of tax collections of the Union, states, the Federal District, and the ten most populous municipalities in Brazil, as well as the resources transferred to each state and Federal District. This analysis of fiscal data aims to determine whether tax resources are centralized within the Federal Government, which central entity's tax collects the most revenue, and whether subnational entities have financial resources from their own tax revenues to cover their expenses, or whether they depend on the Federal Government through revenue sharing mechanisms or even voluntary transfers. The research is based on critical analysis and a synthesis of academic sources, specialized literature, laws, and relevant regulatory documents on fiscal federalism, tax reform, and, specifically, Constitutional Amendment 132 of 2023. | |
