dc.description.abstractConhecida como Constituição Cidadã, a Constituição Federal de 1988 reconheceu direitos individuais e coletivos num contexto de abertura do país a um regime democrático. O processo constituinte permitiu a participação direta e ampla de diversos setores da sociedade civil, inclusive atores invisibilizados como os povos indígenas. Desde o início da década de 1970, quando o movimento indígena começou a ser gestado, havia o anseio por participar das decisões políticas do país, e este pôde ser concretizado através da Assembleia Nacional Constituinte de 1987-1988. Entre as principais pautas do movimento, estavam a demarcação das terras indígenas e o reconhecimento de sua autodeterminação. As reivindicações pelo reconhecimento do direito originário sobre seus territórios e a delimitação das áreas que englobassem as relações das comunidades com seus espaços esbarravam nos critérios e limites impostos pela legislação ordinária que regulava o procedimento administrativo de demarcação. Assim, as tensões na relação dos indígenas com o Estado, causadas pela morosidade dos processos, eram intensificadas pela indefinição de um conceito constitucional que fosse suficiente para dirimir conflitos interpretativos. Dessa forma, o presente trabalho busca resgatar os debates políticojurídicos que se deram na ANC de 1987-1988 sobre a construção do Art. 231 da Constituição Federal de 1988, com o seguinte problema de pesquisa: Como se deu a tematização do conceito de terra indígena na constituinte de 1987-1988? Para trazer essas reflexões, a pesquisa buscou, inicialmente, discorrer sobre o contexto pré-constituinte, trazendo considerações sobre a mobilização do movimento indígena, a partir de sua formação, discutindo as propostas enviadas à Constituinte, como a encaminhada à Comissão Provisória de Estudos Constitucionais, assim como a sua participação no processo de elaboração do novo texto constitucional e as sugestões dos cidadãos aos constituintes. Em seguida, abordou-se a atuação dos atores parlamentares e extraparlamentares, distinguindo as bancadas pró-indígena e anti-indígena nos debates, presentes nas atas das audiências públicas da Subcomissão dos Negros, Populações Indígenas, Pessoas Deficientes e Minorias, da Comissão de Ordem Social e da Comissão de Sistematização, bem como no Plenário até a promulgação do texto final. A pesquisa, predominantemente documental e bibliográfica, está baseada nos fundamentos do contextualismo histórico de Quentin Skinner e na metodologia historiográfica de Pietro Costa. Através do estudo, percebeu-se que o tema da definição sobre terra indígena surgiu como demanda do movimento indígena e que apesar dos desafios enfrentados pelo avanço da temática, entre emendas supressivas, aditivas e modificativas de dispositivos, conseguiu alcançar o status constitucional inédito. Contudo, apesar de representar uma vitória para o movimento, não encerrou os debates sobre a questão conceitual do termo, que permanece como objeto de discussões atuais, e segue na fase constante de efetivo reconhecimento
dc.description.abstract2Known as the Citizen Constitution, the 1988 Federal Constitution recognized individual and collective rights, in a context of opening the country to a democratic regime. The constituent process allowed the direct and broad participation of various sectors of civil society, including invisible actors such as indigenous peoples. Since the beginning of the 1970s, when the indigenous movement began to take shape, there was a desire to participate in the country's political decisions, and this could be realized through the National Constituent Assembly of 1987-1988. Among the main agendas of the movement were the demarcation of indigenous lands and the recognition of their self-determination. The demands for the recognition of the original right over their territories and the delimitation of the areas that encompassed the communities' relations with their spaces came up against the criteria and limits imposed by the ordinary legislation that regulated the administrative demarcation procedure. Thus, the tensions in the relationship between indigenous peoples and the State, caused by the length of the processes, were intensified by the lack of a constitutional concept that would be sufficient to resolve interpretative conflicts. Thus, this paper seeks to rescue the political and legal debates that took place in the ANC of 1987-1988 on the construction of art. 231 of the Federal Constitution of 1988, with the following research problem: How was the thematization of the concept of indigenous land in the constituent assembly of 1987-1988? To bring these reflections, the research initially sought to discuss the pre-constitutional context, bringing considerations about the mobilization of the indigenous movement, from its formation, discussing the proposals sent to the Constituent Assembly, such as the one sent to the Provisional Commission for Constitutional Studies, as well as its participation in the process of drafting the new constitutional text and the suggestions of citizens to the constituents. Then, the performance of parliamentary and extra-parliamentary actors was addressed, distinguishing the pro-indigenous and anti-indigenous benches in the debates, present in the minutes of the public hearings of the Subcommittee on Blacks, Indigenous Populations, Disabled People and Minorities, the Social Order Commission and the Systematization Commission, as well as in the Plenary until the promulgation of the final text. The research, predominantly documentary and bibliographical, is based on the foundations of Quentin Skinner's historical contextualism and Pietro Costa's historiographical methodology. Through the study, it was realized that the theme of the definition of indigenous land, emerged as a demand of the indigenous movement, and that despite the challenges faced by the advancement of the theme, between suppressive, additive and modifying amendments of provisions, managed to achieve the unprecedented constitutional status. However, despite representing a victory for the movement, it did not end the debates on the conceptual issue of the term, which remains the subject of current discussions, and continues in the constant phase of effective recognition
