Organizações indígenas: o novo cenário pós Constituição Federal de 1988 com a mudança do paradigma jurídico e social dos direitos indígenas

| dc.description.abstract | A conquista do território brasileiro, pelos portugueses, em meados de 1500, impõe reflexos sociais aos povos indígenas em pleno século XXI, em virtude de anos de esquecimento dessas pessoas. Assim, ao longo da história jurídico-social brasileira, a legislação brasileira não soube tratar os indígenas considerando suas peculiaridades, visto que até pouco tempo atrás o Estado pautava-se no integracionismo do indígena. Destarte, por vezes excluídos e ora obrigados a integrar a sociedade de massa brasileira, os indígenas viram seus direitos serem descartados e ignorados. Contudo, em 1988, com a promulgação da vigente Constituição Federal, os indígenas puderam se autodeterminar em razão de sua capacidade garantida pelo artigo 232, alcançando, no plano formal, sua capacidade de direitos. Nessa toada, o presente trabalho apresenta a temática relacionada ao direito dos povos indígenas, com foco especial na possibilidade garantida a estes por meio da Constituição Federal de 1988 em se auto organizarem para defender suas terras, cultura, história, direitos, bem como participarem de discussões políticas de forma paritária. Nesse sentido, o estudo aqui pautado analisa os diversos marcos históricos conquistados pelos indígenas, mas também os retrocessos enfrentados em sua luta por igualdade. Dessa forma, analisa-se a construção social da tutela orfanológica e suas implicações, na qual o Estado detinha controle sobre as populações indígenas, incapacitando-os de exercer atos da vida civil desassistidos. Nesse cenário, é imprescindível rememorar que o Brasil não foi o único país que não soube lidar jurídica, política e socialmente com seus povos originários, razão pela qual o assunto chegou nas Cortes Internacionais. Ainda, tratados internacionais e convenções sobre direitos humanos foram importantes na conquista, dentro do ordenamento jurídico doméstico, de direitos dos povos indígenas, dentre os quais merece destaque o Pacto de San José da Costa Rica, que tanto revolucionou o direito doméstico. Ademais, tem-se como norte o estudo teórico da criação, desenvolvimento, reconhecimento e legalização das organizações civis indígenas. Posteriormente, ressalta-se que a luta indígena congregou um movimento uno de indígenas nacionais em busca de igualdade formal e material nos mais variados aspectos da vida civil. Ainda, por meio do presente, perquire-se o impacto que tais organizações tiveram no desenvolvimento dos direitos indígenas e sua atuação na atualidade, bem como sua passagem da ilegalidade ao reconhecimento constitucional. Nesse diapasão, analisa-se o liame que existiu entre o reconhecimento da capacidade civil dos indígenas e o funcionamento das organizações sociais desses povos, que passaram a funcionar plenamente sem ingerências do Estado. | |
| dc.description.abstract2 | The conquest of Brazilian territory by the Portuguese in the mid-1500s imposes social consequences on indigenous peoples in the 21st century, due to years of forgetfulness by these people. Thus, throughout Brazilian legal-social history, Brazilian legislation did not know how to treat indigenous people considering their peculiarities, since until recently the State was guided by indigenous integrationism. Thus, sometimes excluded and sometimes forced to integrate Brazilian mass society, indigenous people saw their rights discarded and ignored. However, in 1988, with the promulgation of the current Federal Constitution, the Indians were able to self-determine themselves due to their capacity guaranteed by article 232, finally achieving their capacity for rights. In this vein, this work presents the theme related to the rights of indigenous peoples, with a special focus on the possibility guaranteed to them through the Federal Constitution of 1988 to self-organize to defend their lands, culture, history, rights, as well as participate in political discussions on an equal basis. In this sense, the study outlined here analyzes the various historical milestones achieved by indigenous people, but also the setbacks faced in their fight for equality. In this way, the social construction of orphanological guardianship and its implications are analyzed, in which the State had control over indigenous populations, disabling them from carrying out unassisted acts of civil life. In this scenario, it is essential to remember that Brazil was not the only country that did not know how to deal legally, politically and socially with its original peoples, which is why the matter reached the International Courts. Furthermore, international treaties and conventions on human rights were important in achieving, within the domestic legal system, the rights of indigenous peoples, among which the Pact of San José in Costa Rica deserves to be highlighted, which so revolutionized domestic law. Furthermore, the guiding principle is the theoretical study of the creation, development, recognition and legalization of indigenous civil organizations. Subsequently, it is highlighted that the indigenous struggle brought together a united movement of national indigenous people in search of formal and material equality in the most varied aspects of civil life. Furthermore, through this study, we explore the impact that such organizations had on the development of indigenous rights and their performance today, as well as their transition from illegality to constitutional recognition. In this vein, we seek to analyze the link that existed between the recognition of the civil capacity of indigenous people and the functioning of the social organizations of these peoples, which began to function fully without interference from the State. | |
